Former Obama AG Joins DJI Lawsuit Against Pentagon

Chinese drone manufacturer DJI has filed a lawsuit against the Department of Defense, challenging its designation as a “military company” by the Pentagon. The lawsuit, filed in federal court in Washington, D.C., names Defense Secretary Lloyd Austin and Deputy Defense Secretary Laura Taylor-Kale as defendants. DJI claims that the designation is unjustified, arguing that the company’s products are intended for commercial and consumer use, not military operations.

Loretta Lynch, who served as U.S. Attorney General under President Obama, has joined DJI’s legal team. Her involvement has drawn criticism from lawmakers like Rep. Elise Stefanik (R-NY). Stefanik called it “disgraceful” that Lynch is working on behalf of a company flagged by the Pentagon as a potential threat to national security. Stefanik argued that U.S. officials should be advocating for American security, not foreign interests.

The lawsuit comes after months of back-and-forth between DJI and the Department of Defense. DJI contends that it has tried to engage with the Pentagon for over a year, requesting clarification on the company’s designation. After being ignored, the company decided to take legal action to remove the military label and clear its name.

Congress is currently considering a bill that would ban future imports of DJI drones. The bill, which has already passed the House, is pending action in the Senate.
