DOJ Pushes To Block Reexamination Of George Floyd’s Heart Samples

The Department of Justice has asked a judge to overturn a decision allowing Derek Chauvin’s legal team to reexamine tissue and fluid samples from George Floyd’s heart. Chauvin, the former Minneapolis police officer convicted in Floyd’s death, is seeking to appeal based on a theory that Floyd died of a preexisting heart condition.

U.S. District Judge Paul Magnuson recently granted Chauvin’s legal team access to Floyd’s heart samples to test the theory. Chauvin’s defense claims Floyd may have suffered from a “catecholamine crisis” linked to a rare tumor, paraganglioma, which could have led to acute heart failure or pulmonary edema.

Federal prosecutors strongly opposed the judge’s decision, calling the request “baseless” and suggesting it undermines the integrity of prior legal proceedings. “It defies belief that, if Defendant had been aware of a weaker medical defense theory than the one already rejected by his state jury, he would have chosen trial again,” prosecutors argued in court filings.

Chauvin’s federal defense attorney, Robert Meyers, has argued that Chauvin’s original lawyer, Eric Nelson, failed to properly inform him of alternative medical theories presented by pathologist Dr. William Schaetzel. Meyers contends that this oversight amounted to ineffective counsel, warranting the appeal.

Judge Magnuson’s decision to allow the heart samples to be reexamined has drawn sharp criticism from Biden regime prosecutors, who seem intent on depriving an American citizen of avenues he intends on using to prove his innocence — regardless of the White House’s preferred outcome.
